PRIVACY POLICY

Welcome to Yomod (the "Service")! Yomod is committed to protecting the privacy of our users and complying fully with the Children's Online Privacy Protection Act of 1998 ("COPPA"). COPPA requires us to inform parents and guardians about how we collect, use and share personal information from children under 13 years old. Yomod, LLC is the sole operator of the Service; parents and guardians can review the child's personal information, ask to have it deleted and refuse to allow any further collection or use of the child's information, at any time using the following contact details:  Yomod, LLC, 14 Diane Lane, Suite 100, Larkspur, CA 94939, (489) 247-4206, privacy@yomod.com.

What Information Do We Collect?

Only with verifiable parental consent, we collect certain information from young people for internal purposes only. When a young person signs up for Yomod, we collect some information, such as name, gender, age, zip code, country and e-mail address. We only collect information necessary for users to participate in the Service, keep the Service safe, and implement planned new features such as groups. To complete registration, we require a parent or guardian to provide certain information, such as name, e-mail address and valid credit card details. We do a credit card transaction to verify parental consent to collect and use their child's information, consistent with this Privacy Policy, and to help keep the Service safe. We never charge the credit card, and we do not keep complete credit card details on file once we have verified parental consent.

As is standard practice on many Web sites, we use “cookies” and other technologies to help us understand which parts of Service are the most popular, where our visitors are going, and how much time they spend there. This data is not correlated in any way with any personally identifiable information.

When you use the Service, our servers automatically record certain information that your Web browser sends whenever you visit any Web site. These server logs may include information such as your Internet Protocol ("IP") address, Web browser type, number of clicks, domain names, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and the like. This data is not correlated in any way with any personally identifiable information.

How Do We Use The Information We Collect?

If you submit personal information on or through the Service, then we use your personal information for internal purposes only, such as to operate, maintain and provide to you the features and functionality of the Service and to customize and improve your experience on the Service.

We do not use your e-mail address or other personal information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your e-mail address without further consent for non-marketing or administrative purposes (such as notifying you of major Service changes or for membership services). We use both your personal information and certain non-personal information (such as anonymous usage data, cookies, IP addresses, Web browser type, clickstream data or other details that alone could not be used to identify or communicate with you) to improve the quality and design of the Service and to create new features, promotions, functionality and services by storing, tracking and analyzing user preferences and trends.

We use "cookies" and other technologies to:  (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Service; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in contests, sweepstakes and other promotions.

When Do We Share Information?

We currently do not share personal information with third parties. If we ever do, we will amend this Privacy Policy first and parents and guardians always will have the option to agree to the collection and use of the child's information without consenting to the disclosure of the information to third parties. We may share non-personal information with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions or functionality on the Service. We may release personal information and non-personal information if required to do so by applicable laws, or in the good faith belief that such action is necessary to comply with applicable laws or respond to a valid court order, subpoena or search warrant. We also reserve the right to disclose personal information and non-personal information that we believe, in good faith, is appropriate or necessary to enforce our Terms of Service, take precautions against liability, to investigate and defend against any third party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Service, and to protect the rights, property or personal safety of the Service, its members and other users.

What Are Your Choices?

You may, of course, decline to submit personal information on or through the Service, in which case, Yomod may not be able to provide certain services to you. You may update or correct your personal information at any time by visiting your account profile. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your profile account or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times. You, or your parent or guardian, can change or remove your information on our system at any time using the following contact details:  Yomod, LLC, 14 Diane Lane, Suite 100, Larkspur, CA 94939, (489) 247-4206, privacy@yomod.com.

What About Links To Third Party Web Sites?

The Service may contain links to third party Web sites and resources, over which we have no control. Privacy policies on such linked Web sites and resources may be different from our Privacy Policy. You access such linked Web sites and resources at your own risk. You should always read the privacy policy of a linked Web sites or resource before disclosing any personal information on such linked Web site or resource.

What About Third Party Service Providers?

We may contract with companies or persons to provide certain services including credit card processing, shipping, data management, promotional services, advertisement serving, measuring the effectiveness of our advertising and how visitors use the Service, etc. ("Service Providers"). We provide our Service Providers with the information needed for them to perform these services. We also ask our Service Providers to confirm that their privacy practices are consistent with ours—that is, they must agree to protect any information we share with them at least as well as we do.

How Secure Is The Service?

Yomod uses sophisticated encryption and authentication tools to protect the security of personal information. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect personal information, we cannot guarantee or warrant the security of any information you transmit on or through the Service, and you do so at your own risk. We urge you to keep your unique password in a safe place and not to divulge it to anyone. Also, remember to sign off your account and close your Web browser when you have finished your visit. This is to ensure that others cannot access your account profile, especially if you are sharing a computer with someone else or are using a computer in a public place, such as a school or library.

What If We Are Sold Or Merged?

In the event that Yomod or the Service is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale or other change of control transaction. In the unlikely event of Yomod's bankruptcy, insolvency, reorganization, receivership or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred or used.

What About Changes To The Privacy Policy?

We may change this Privacy Policy from time to time. Any changes to this Privacy Policy will become effective as soon as they are posted on the Service. The new Privacy Policy will apply to all current and past users of the Service and will replace any prior Privacy Policies that are inconsistent.
